What do you do if someone hands in their notice and then wants to use their holiday as part of it?

Monday morning an employee hands, you weren’t expecting it and then they say they have three weeks holiday and they want to take it as part of their notice!

Unless their contract states it the employee is able to take whatever untaken holiday is left of their statutory annual leave.  As their employer you can only refuse this request for annual leave for valid business reasons, anything else could be seen as discriminatory.

 

The best thing is to talk to the employee to see if a compromise can be agreed on how much holiday is taken in the notice period and ensure there is a proper handover.
